Ask a Lawyer - Power of Attorney
Answers to Your Questions on the Power of Attorney
Question:  Does a Power of Attorney take affect when I am disabled?

Answer:  It depends.  A Durable Power of Attorney takes effect immediately.  A Springing
Power of Attorney “springs” into place at such time or event (e.g., disability) as you designate.

Question:  Whom should I choose to be the agent for  my Power of Attorney?

Answer:  It should be someone you trust.  Someone who is willing to take on this
responsibility and has the ability to carry out the financial matters required.  Proximity,
education, the ability to handle their own affairs and your bond with that person all have to be
considered when assigning this very important power to another person.

Question:  Once the Durable Power of Attorney is set up, can it ever be canceled?

Yes, a Durable Power of Attorney can be revoked or cancelled.  You should contact your
Attorney about the steps you need to take to do this.
