Scope of Services Provided
Our law firm practices estate planning law and provides legal services within New
York State. A New York State licensed Attorney prepares and reviews all your
Wills and estate planning legal documents.
The course of representation will follow the steps outlined below:
1. Client will order the estate planning legal document that he/she chooses and
forward the related interview questionnaire. (Client assumes responsibility for
delays caused by not promptly forwarding the completed interview questionnaire.)
2. A New York State licensed Attorney will manage and review your completed
interview questionnaire, including your stated objectives, any special concerns and
needs, and questions.
3. If either Client or Attorney has any questions or follow-up questions, they will
first contact each other by email, and then Attorney's Office will follow up by phone
as needed. (Clients can use the clients@nywills.com email address to reach us.)
4. A New York State licensed Attorney will plan and prepare the 1st Draft of your
estate planning legal document, taking into account your specific objectives,
concerns and needs. (You may choose to receive this draft either by email or by
first class mail. At your specific request, we can also send by certified mail, at no
additional cost to you.)
5. If there are any changes or questions, Client will contact Attorney by email, and
then Attorney's Office will follow up by phone as needed.
6. Attorney will revise and prepare your Final Document, taking into account any
required or requested changes. In addition, Client will receive complete and
detailed Signing Instructions. (You may choose to receive the Final Document and
Signing Instructions either by email, or by first class mail - laser printed on high
quality paper. At your specific request, we can also send by certified mail, at no
additional cost to you.)
Attorney will be available to respond to any questions that Client may have
regarding the Signing Instructions. Client understands that he/she is responsible
for effectuating the estate planning legal document by following the Signing
Instructions in a timely, correct and complete manner.
Ordering an estate planning legal document or filling in an interview questionnaire
does not guarantee representation. We reserve the right, at our sole discretion, to
refuse representation on any matter. If we are unable to represent you, we will
notify you promptly and promptly return any monies that you may have already
forwarded to us.
Other Services
As previously mentioned, the Signing Instructions may require that a Client take
some responsibility for effectuating their document. Although most documents
require only the proper signatures, some estate planning documents may require
further proper follow through. E.g., a Will requires the Client to gather 2 to 3
witnesses, to have certain documents notarized, and to follow certain formalities.
E.g., a Trust may require the Client to transfer title to certain property to the
control of the Trust.
The large majority of our Clients will be fully capable of following these instructions.
(In fact, it is when our Clients undertake these generally ministerial duties that
primarily enables our Law Office to charge the reasonably low rates that we do.)
However, at the specific request of those Clients that find it necessary, our Law
Office can provide additional services at an additional to be agreed upon fixed or
hourly rate. For example, in New York City, if you desire, we can provide face to
face Attorney supervision for the signing of a Will, as well as the use of our Office
and a Notary. Or, in the matter of a Trust, we may be able to assist with the
transferring of title to certain property to the control of the Trust.
Free, Unlimited Revisions for 2 Years
For all our estate planning and other documents, you are entitled to free, unlimited
revisions for 2 years from the date you receive your Final Document. After your
3rd revision, we reserve the right to apply a shipping and handling fee for each
subsequent revision. These free, unlimited revisions only apply to changes and
modifications where the original matter, transaction, parties, and underlying factual
circumstances are substantially the same.

We provide a 100% Satisfaction and Refund Guarantee - if you are not 100%
satisfied with all aspects of our service, including its affordability, we will promptly
refund the entire amount back to you. Just let us know by email or letter within 60
days after your payment - no explanation is required.

Governing Law and Venue
This Agreement shall be governed by the laws of the State of New York without
reference to principles of conflict of laws. Any action or proceeding arising out of
this Agreement shall be brought in a county or Federal district court located within
New York County, New York, and the Parties hereby consent to said venue.
Arbitration
In the event that a dispute arises between us relating to our fees, you may have
the right to arbitration of the dispute pursuant to Part 137 of the Rules of the Chief
Administrator of the Courts, a copy of which will be provided to you upon request.
Limitation of Liability and Damages
To the extent permitted by applicable law and the Code of Professional
Responsibility, our Law Office and our representatives will not be liable to you for
any indirect, special, incidental or consequential damages (including but not limited
to loss of business, loss of profits and the like), whether based on breach of
contract, breach of warranty, tort (including negligence), product liability or
otherwise.
Entire Agreement
This document constitutes the entire Agreement between Client and our Law
Office, and no promises or representations, other than those contained here and
those implied by law have been made. Any modification to this Agreement must be
in writing, signed by both parties. If any portion of this Agreement is found invalid
or unenforceable by any court, the remaining provisions shall remain in force
between the parties.

Outside New York State, although we have the same New York State
Attorney(s) carefully reviewing and preparing your estate planning
documents (customized for your State, except Louisiana), we can only
provide document assembly services and are not licensed to represent
you as Attorneys nor provide you with legal advice or opinion.) At your
option, you may choose to have an Attorney in your State review your
documents.
